Coaches and TSSAA isn’t the problem. If Lee don’t want to lift the order nobody will play unless somebody challenges them legallly and it goes to a higher court, which could happen especially with the possible monetary losses HS kids could lose with potential athletic scholarships and big money school losses. If I was Lee I would make the schools sign Covid Waiver Forms and the chances of  any one getting sued is slim over Covid. It for sure won’t be me, but I feel like they will get sued if sports is not played in HS. Lots of lawsuits going on right now in Nashville. He is not a liked man in Nashville.

The Chief Executive at every level of government under a federal system of government has broad powers to make executive orders. President at the National level, Governor at the State and County Mayors at the county level. Courts have upheld these unless they are an unconstitutional order. Courts have avoided overturning these orders as they are bordering on infringing on the concept of separation of powers which is considered a building block of a representative democracy. Long story short, zero chance of a lawsuit over high school sports.

A civil lawsuit over money lost from the order I have heard are already happening from other businesses. Maybe not to change the order, but a civil lawsuit over money lost.

The Federal Tort Claims Act makes it almost impossible to sue the government for damages because of sovereign immunity. You can in some cases sue a government employee for negligence if you can prove they were intentionally negligent and knew it may cause harm. For example, a TDOT worker getting drunk and jumping in a truck and causing an accident. This would never include acts or laws passed or made by the government.

So why are school leaders saying the government is scared of getting sued if someone catches Covid?  Basically what you are saying if there is verbage in the Executive Order written by the governor their is no liability. Based on what you are saying if there is verbage in the order not prohibiting contact sports he should be OK.

I don’t give out personal name info. It ain’t just school leaders. All the talk is liability about Covid. Your saying the government is bulletproof over verbage in an Executive Order. So sounds like if the governor makes the call there is no liability with Covid.

Google Nashville business owners sue Governor Lee and read all the businesses especially downtown. Kid Rock and a bunch of them and they are saying it was unconstitutional. They say in the articles that constitutional rights were violated: economic rights, rights to travel, freedom of association...and many more. Whole page of lawsuits going on with Governor Lee. Just saying people sue for anything now and there is lots of money lost from his decisions especially him claiming what businesses are essential and non-essential. You think TSSAA and schools will be happy they lose millions of dollars?? Just listened to the TSSAA meeting while ago and they have proposed to the governor to be treated as their own entity like the NCAA and the NFL. One of the drawbacks was the HIgh Schools can’t test like the NCAA and the NFL. Well a TSSAA fired back and said NAIA and Div 2 don’t have testing budgets either and they wanted to be classified like they are in the order. The TSSAA spokesperson commenting said the governor might include the HS’s in with the colleges and NFL and that would be great news for football giving the TSSAA the day so. TSSAA said they are equipped and ready for it. So we will see what happens. But I will tell you their are a lot of folks zeroed in on this thing. Most folks are not happy about the two month extension and how it effects sports, when they could have very easily made the deadline August 1st.

You can sue all day long it doesn't matter if the ones you are appealing to are the very ones you are trying to sue....

They are talking right now about passing more legislation to give various groups immunity from liability related to Covid.

That is right. There are things in the works. Hopefully it works out. Hopefully the numbers get under control and sports are played.

You also didn't know he was a faculty coach again so how much do you really know? Some people outside this county baffle me with their need to slander others.

Have you asked any of the 30+ parents that signed a petition to get him reinstated at the board meeting this week how they feel about this? Just let it play out, at the end of the day the only people that will bring TC back are the ones that know what its about at its core.    People hate losing and they aren't used to it at TC. I for 1, and I'm sure others too, understand having a dip in talent and not being able to compete for a state title every year. But in the past, TC teams have outworked more talented teams, they didn't continuously lose the turnover battle, they didn't commit 8+ penalties in several games each season, and I believe several of the folks in town that want Blake out feel as if he is neglecting the history of the program. This is from a source that used to be extremely close to the program (not me lol), Blake gets out of school midday and the players show up and there is no practice plan or itinerary.  I also understand those that are on team Blake, when he has loads of talent, he wins. He does know football and he is a tremendous DC, and if the rumors are true then he will do great things. As for the board member issue, it is what it is, everyone that's true to the county know that and nothing has changed. I agree though that they should strive to make the facilities as good as we can. And as far as potential candidates, I agree there is very few options. West, Vetetoe (yes I know), and couple others that could have some interest. Whatever happens is massive for the program during a pivotal time before the next big wave of stars make their way through.
