The Tennessean Is reporting on its website that the Supreme Court has ruled in favor of upholding Recruting rules that state associations set and that the TSSAA did not violate free speech rights of Brentwood Academy.....................What will happen as a rsult of this decision?

 

The TSSAA will breath a large sigh of relief and hit the funds set aside to pay off BA legal fees for a vacation.

 

Other than that it will be buisness as usual. /dry.gif" style="vertical-align:middle" emoid="

I assure you the NCAA also has a sigh of relief. A verdict the other direction would have established a precident that could have been used in college football as well. The case had much greater significance than BA v. TSSAA.

CONGRATS to the TSSAA for never giving up. The Supreme Court of the U. S. A. saw thru the smoke screen. What a victory for public schools.

THIS IS IT, NO MORE APPEALS. BA cannot appeal this final decision because the Supreme Court final ruling. Supreme Court made the decision if this was a violation of BA free speech. It is over, no more appeals. TSSAA is breathing easier today as most programs in the TSSAA.

In 2001, the Supreme Court decided the TSSAA was a state actor and could be be sued for alleged First Amendment violations. On remand, the Sixth Circuit ruled on the merits in favor of the school. The Supreme Court reversed this decision Thursday, holding that "an athletic league's interest in enforcing its rules sometimes warrant curtailing the speech of its voluntary participants." The Court also determined that the TSSAA held a fair hearing in the case and did not violate Brentwood's due process rights. with the political make up its rare to get unanimous decisions out of the supreme court

 

The big question? Who pays the lawyers?

 

Generally in situations like this the parties pays their own lawyers, but in this case it will be every kid in Tn both publics and privates.

 

Shadow what I was congratulating BA about is standing up for their belief that they were right whether they were or not. That in itself is rare in todays society. It is VERY expensive to bring a case to the Supreme Court and they put their money where their belief was.

 

Whether we want to believe it or not recruiting goes on at EVERY school in Tn to some extent or the other. It could be by a Coach or alum or even a kid just asking a friend to come to where they are. It goes on and those who say it does not don't get out in the REAL world very much.

 

82cat, I agree that it is very rare to get 9 Judges to agree on ANYTHING. Especially the Supreme Court.

BA donors, maybe....not the school. Another advantage for

private schools, who do recruit more than public schools.

The law firm for BA is made up partly of BA grads. It is possible that the case is pro bono since they lost.

    • Never said I thought it was a smart decision. I'm scratching my head at it too.
    • If he wanted to play QB he should have either went to Heritage or William Blount and had a real good chance there. In stead he'll be exactly what he was going to be at Maryville. They already know who their QB is going to be in 2025 and it ain't going to be him.

    • You are correct.   The teacher's pay scale is virtually the same in Knox County, now, as it is at Oak Ridge.   The coaching supplements are still higher at Oak Ridge, from what I was told, but not a huge difference.   Plus, Rusty is going from a position coach to an OC position, which is what he was at South Doyle and where his comfort zone is.  And from a special education teaching slot to a PE teaching slot.  There is a lot of positivity in that move without even considering the coaching aspect.   Anybody who sees something negative here is just looking for negativity to begin with.  But some live in that world.   Really good hire for Brent.  He now has two experienced and quality coordinators and can concentrate on being a head football coach.
