Will the TSSAA sue the plaintiff for legal fees? Generally the plaintiff has the larger legal bill in a civil case. In this case, wonder if Barfield and BB&S gave BA a discount.

 

 

I understand that the decision was made not to go after BA for the attorneys fees paid by TSSAA. I bet the reverse would not have been true had BA prevailed.

I imagine their decision not to pursue BA for legal fees had to do with the liklihood they wouldn't prevail. Had BA's suit been without merit and determined to be frivolous they might have had a case. This case went through multi federal appeals and to the Supreme Court twice. Hard to call that frivolous.

BA had decided to not pursue legal fees had they won. It would have been at the expense of member schools, and BA's administration didn't think it was in anyone's best interest to attempt to recoup.
