Is that how changes should be made?

 

Break a small rule, fight for freedom of speech in court,

win a ruling, and then try to run the association?

JMO, but BA will offer to allow the TSSAA to pay a reduced portion of the legal fees if the TSSAA will agree to make some concessions. I could see BA requesting that the TSSAA do the following:

1. Do away with D1 & D2 and place everyone back together

2. Terminate Mr. Carters contract with the TSSAA

3. reserve X number of spots on the Board of Control for private school members

 

The TSSAA would have no choice but to do what BA request unless they can find the money to pay the legal fees in full. Let's keep in mind the fact that the TSSAA will have to pay the fees when the legal battle is over. There will be no payment plan over a period of time unless <a href='http://www.coacht.com/inside/team.cfm?SchoolID=37&SportID=1' target='_blank'>Brentwood Academy</a> grants the TSSAA permission to pay on an installment plan.

Did they break a rule Stan? I guess you are the only one that knows what undue influence means.

If all of the schools are thrown back in together, I'd say you would have the multiplier thrown out. Here's what I came up with, moved a few up to 5A as I think that's where they'd want to be. More moving up would change the list just a little. Look at the teams in each division, I don't think anyone should want a four class group and especially not a three class. 100-0 scores should be avoided if possible. With a three class football system, you'd probably have Alcoa in the same region with Grace of Knoxville. With this many schools, more schools opening in the last few years and more to come, I'd hope a four-class system in basketball, baseball and softball would be looked at.

I think your suggestions are legitimate and within the rhelm of possibility. Personally, I would love to see all three things happen. Just think, starting with the 07-08 scheduling which is currently up for changes anyway, we could have everybody back together again...one big happy family...ok maybe not that last part.

 

 

i still don't understand why you dont want to go to school with people that goes

to public schools, but you want to play sports on friday. makes no sense to me.

this is going to get ugly.

why seek a "compromise" on BA's legal fees?

why go to 4 classes, or 3?

they won, lets give 'em their spoils.

what's the use of a tssaa that operates at the beck and call of moneyed privates?

nah, pay 'em off and get back to basics.

 

football- 1 class, bowl games, no playoffs. let 'em divide into conferences however they please.

(i am sure the conferences wouldnt fall into a de facto split)

 

basketball- 1 class, one state champion. strictly geographic districts.

 

baseball-same as football.

 

all the other sports, cut them loose.

 

we could get our new one-man tssaa staff by advertising on the internet:

 

"work from home in your spare time"

 

it isnt the publics that NEED a slew of gold balls to attract new students and stay alive. it isnt the publics that have the most to lose.

 

privates do have their grievances, and cant be blamed for feeling like they are in the driver's seat right now.

but the term "pyrrhic victory" hasnt stuck around for millenia for nothing.

 

be careful what you ask for, you just might get it.

One of two things will happen.

1. TSSAA will charge member schools X number of dollars for X number of years to pay attorney fees b/c TSSAA is just the governing body of its representing schools.

 

2. TSSAA will file for bankrupty and start over without any private school allowed in membership. Private schools can start their own association.

 

Do not forget what this whole thing is about. TSSAA believed BA was recuiting. TSSAA bylaws say it is illegal to recruit in any form of communication by a member school or its representatives. TSSAA was right on that principle. And that's all the TSSAA was concerned about. Unfortunately, BA and the courts said that was against their 1st amendment rights. So if BA and other private schools do not want to abide by this rule that was put in place it own member schools (board of control) than its an obvious slap in the face to every public and/or private school that does abide by its own rules.

TSSAA is not going to make everybody happy with every decision - Just like winning a game or an officials call- one side is happy and the other greatly disappointed.

 

Going to one class in all sports will not aid anyone - the smaller schools (most of the time) cannot compete with the larger 5A FB or 3A Other sports - The bigger the pool to draw from the more talent you have, a fact. Most smaller programs are lucky if they get enough kids to play. There are alot of changes that need to be made, but a committee of the different regions and classifications should be questioned to see what the majority feel would be fair to all. Just a suggestion.

I would assume that the lawyers had hard costs, and

expect to be paid or have been paid.

 

Surely Bass, Berry & Sims have better uses of their

philanthropic services. This firm has handled this

case to simply "stick it to the TSSAA?"

 

 

 

Wouldn't you think that this was a pro bono case by the lawyers, possibly BA grads or supporters, if BA lost and a keep enough to cover expenses and donate the rest of what BA gets from the TSSAA back to BA in case of a win? Wouldn't that be about as "in-your-face" to the TSSAA as it could get and isn't that what this is about, anyway?
