He was not on the line of scrimmage and his hand was never down. He could legally go in motion.

Unless the video I saw was not correct he was on the line and never got set.  He would have been a downed blocker

No he wasn't. He was lined up as an eligible receiver off the line in a standing position.  He doesn't have to go to a set position.  As long as he doesn't move forward he is fine. 

But continue to whine and make excuses as you will.

I am not making excuses I don't particularly like Oakland, but it was a bad call.
