I don't think it matters.  I just looked at the bylaws, and there is nothing covered other than "sanctioned TSSAA sports", and freshman and JV aren't "sanctioned".  

But I certainly have been wrong before, but I am relatively certain that it doesn't matter if he is a tuition student or not.  The key is that it is a transfer without a change in residence.

It is my understanding of the rule that he is eligible to play JV/Freshman ball right now, just can't play any varsity, and he will have to sit out the first varsity game next season.
