Because the T$$AA says they can, but the Metro Nashville Schools administration says they can't.  Private and independent schools are just that - private and independent.  They don't answer to local school district administration like the public schools do.

Because the letter came from the county health director, this applies to the private schools also.  MBA headmaster is also a signer of the letter.
